These Terms and Conditions (“Terms”) govern your use of the design and development services (“Services”) provided by MythMaker Creations (“Company”, “we”, “us”, “our”), a creative agency specializing in services for self-published authors. By engaging with our Services, you (“Client”, “you”) agree to be bound by these Terms, which constitute a legally binding agreement between you and the Company.
The Company offers various Services to assist self-published authors, including but not limited to Book Cover Design, Interior Formatting, Logo Design, and Website Design and Development. Each project (“Project”) will be governed by a specific scope as agreed upon in a Project Brief, which will be confirmed in writing between the parties.
Services are provided according to the payment structure of the selected package (Starter Cover Pack, Book Launch Pack, Pro Author Pack), involving an initial deposit and staged payments based on milestone completions.
Deposits are refundable under specific conditions as outlined in the package terms. Detailed provisions for cancellations and refunds at various stages of the project are provided within each package description.
All rights, title, and interest in the creative works produced by the Company for the Client shall remain with the Company until full payment has been received, at which point ownership will transfer to the Client.
The Company may use third-party assets (e.g., stock images, website templates) that are licensed for commercial use. The Client is responsible for any additional licensing or permissions required for their specific use case.
The Company shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill. The Company’s total liability under any provision of these Terms is limited to the amount actually paid by the Client to the Company for the Services under these Terms.
The Company may facilitate access to third-party services (e.g., web hosting). The Company is not responsible for the availability, terms, or conditions of such third-party services, and the Client agrees to hold the Company harmless for any damage or loss caused by the use of these third-party services.
The Company offers revisions to its designs within the scope of the Project Brief. Excessive revisions or revisions outside the agreed scope may incur additional charges.
Client approval at various stages is required to proceed. Lack of timely feedback or approval from the Client may result in project delays.
In the event of a dispute, the parties agree to first seek resolution through good faith negotiations. If the dispute cannot be resolved, the parties agree to submit to binding arbitration in the United Kingdom, with the costs to be divided equally between the parties.
The Company reserves the right to amend these Terms at any time. Continued use of the Services after such amendments constitutes agreement to the new Terms.
These Terms constitute the entire agreement between the Client and the Company regarding the Services and supersede all prior agreements and understandings, whether written or oral.
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.
